§ Why am I being recharged in tribal court for a case that was dismissed?
This has been a common question since the McGirt decision. Unfortunately for many people even though the State of Oklahoma lost jurisdiction, tribal and federal courts did not. You can be charged separately in all three.
I've been arrestted. What should I do?
Step 1: Shut up. Invoke your right to stay silent. Remember police officers are trained to get confessions and can even lie to get a confession from you.
Step 2: Call an attorney that is knowledgeable about criminal law and licensed to practice in the court where you will be charged.

I want to drop charges against someone. How do I do this?
It is a misconception that the victim of the crime "presses" the charges. Once a report is made and sent to the prosecuting office it is up to the Attorney General or District Attorney to decide if charges are filed or dropped. However, a victim does have the right to sign an Affidavit Not to Prosecute.
